Terms and Conditions
Article 1 General
1.1 Definitions a- General Terms and Conditions: the general terms and conditions of Interieur by Gina.
b- Interieur by Gina: the user of these General Terms and Conditions; interior designer, registered with the Chamber of Commerce as Interieur by Gina under number 85693553, located at Athenelaan 215, 2152 KL Nieuw-Vennep.
c- client: the natural or legal person who concludes an assignment with Interieur by Gina.
d- assignment: the agreement between the client and Interieur by Gina.
1.2 These General Terms and Conditions apply to all quotations and orders that the client concludes with Interieur by Gina. Interieur by Gina reserves the right to change and expand the General Terms and Conditions.
1.3 If the parties have agreed otherwise than stated in these General Terms and Conditions and have confirmed this in writing, the agreement between the parties applies.

Article 2 Establishment of the assignment
2.1 An assignment with Interieur by Gina is concluded when the client has given Interieur by Gina written or digital approval (by email, text message and/or what's app) to the assignment.
2.2 When entering into an assignment with Interieur by Gina in any form, the client indicates that he agrees with all points mentioned in the General Terms and Conditions.

Article 3 Execution of the assignment
3.1 Interieur by Gina will carry out the assignment at its own discretion and in accordance with good workmanship.
3.2 Interieur by Gina is the client's confidant and advisor. Interieur by Gina relies on the correctness of the data and information provided by or on behalf of the client. If during the execution of the assignment it turns out that this information is insufficient, too late or incorrect and adjustments to the assignment are necessary, the resulting additional costs will be charged to the client as additional work.
3.3 Interieur by Gina may, at its own discretion, have certain work carried out by third parties if this is required for the proper execution of the assignment.
3.4 For optimal execution of the assignment, it is necessary that both Interieur by Gina and the client adhere to the indicated schedule.
3.5 The delivery time specified by Interieur by Gina cannot be regarded as a strict deadline. Interieur by Gina can adjust the planning in the meantime if necessary and will inform the client about this.

Article 4 Changes to the assignment
4.1 If during the execution of the assignment it becomes apparent that for proper execution it is necessary to change and/or supplement the work to be performed, the parties will adjust the assignment accordingly in a timely manner and in consultation.
4.2 The time of completion of the assignment may be influenced by changes and/or additions to the assignment. Interieur by Gina will inform the client of this as soon as possible.
4.3 If the change or addition has financial and/or qualitative consequences, Interieur by Gina will inform the client in advance, unless this is not possible due to circumstances and the performance of the additional work does not allow postponement or results in a serious delay.
4.4 Additional costs resulting from changes to the original order of any nature will be charged to the client.
4.5 If the client does not contribute to the rapid progress of the process, this may have financial and/or qualitative consequences. Interieur by Gina will inform the client about this.
4.6 The client owes compensation for additional work (additional work) by Interieur by Gina for changes to a design at the request of the client that has already been determined or approved.

Article 5 Prices
5.1 All prices stated in Interieur by Gina's quotations are shown in euros exempt from VAT and excluding travel costs.
5.2 All prices stated in a quotation from Interieur by Gina are based on the rates applicable at the time the order was placed. The rates and discounts mentioned do not automatically apply to future services and/or products to be provided.
5.3 Interieur by Gina reserves the right to adjust rates. 5.4 Oral agreements and stipulations are binding after they have been confirmed in writing or by email by Interieur by Gina.

Article 6 Payment
6.1 After a deposit of 10-50% (depending on the assignment) of the agreed amount, Interieur by Gina will start carrying out the assignment.
6.2 In the event of purchasing product(s), the client will receive an invoice for a down payment of 50% of the purchase value and upon delivery an invoice for the remaining payment of 50%. Payment of the remainder must be made no later than the time of delivery. Interieur by Gina uses a payment term of 0 days in connection with pre-financing and delivery.
6.3 Interieur by Gina uses a payment term of 0 days when purchasing products.
6.4 The client is not entitled to suspend and/or offset payments.
6.5 After completion of the assignment, the client will receive an invoice. on the remaining amount. Interieur by Gina has a payment term of 14 days in case of interior design advice.

Article 7 Product, order and delivery
7.1 Interieur by Gina has no products in stock, because all products are custom-made or purchased especially for the client based on the assignment or individual agreement. Products cannot therefore be returned.
7.2 Interieur by Gina is not responsible for any incorrect information about designs, photos and/or other information on websites other than the official website of Interieur by Gina.
7.3 The client must check the order for contents (sizes, color, materials, type, etc.). An order is placed after written/digital approval from the client.
7.4 Interieur by Gina is not obliged to fulfill any obligation with regard to orders if there is force majeure or another unforeseen circumstance that is not attributable to Interieur by Gina.
7.5 For some products it is possible to collect them yourself. For other deliveries, Interieur by Gina will take care of the transport and possible installation. Delivery and installation of products, and any associated costs, will be agreed with the client prior to the final order confirmation.
7.6 Interieur by Gina provides information about the expected delivery time subject to possible delays by third parties.
7.7 Interieur by Gina is not responsible for any additional costs or damage resulting from the lack of sufficient access to the room in which the product is to be delivered. Transport and installation on a higher floor is often possible in consultation with the transporter, and is always entirely at the risk and expense of the client.
7.8 Complaints or deviations from products will be handled by Interieur by Gina.
7.9 All products are covered by a warranty for a period of 12 months after delivery, unless the nature of the delivered goods dictates otherwise or the official product information for the delivered goods or a third party manufacturer states a different warranty period for the product. The warranty will be void if the product is used incorrectly, incorrectly maintained, or if a defect in the product arises due to circumstances beyond the control of Interieur by Gina.
Article 8 Ownership, use & license
8.1 In the context of the services provided by Interieur by Gina, all working drawings, illustrations, designs, sketches, photos and other materials and files provided by Interieur by Gina remain the property of Interieur by Gina, regardless of whether they are transferred to the client. or have been made available to third parties.
8.2 The client is not permitted to publish and/or reproduce the work without mentioning the name of Interieur by Gina without prior permission from Interieur by Gina.
8.3 Interieur by Gina has the freedom to use designs and/or photos for publicity or promotion, taking into account the interests of the client.

Article 9 Liability
9.1 The Client ensures that all information that Interieur by Gina indicates is necessary for the execution of the assignment is provided to Interieur by Gina. If the client has not provided this information, Interieur by Gina is not liable for any resulting damage.
9.2 Interieur by Gina is not liable for damage of any kind because Interieur by Gina relied on incorrect and/or incomplete information provided by the client. (A Funda map is often incomplete and incorrect.)
9.3 Interieur by Gina is not liable for consequential damage, lost profits, missed savings and/or damage due to business stagnation.
9.4.Interieur by Gina is not liable for indirect damage, lost profits, loss of goodwill, business interruption and claims from customers of your client.
9.5 Liability of Interieur by Gina is always limited to the amount of the invoice value of (the part) of the assignment from which the liability arises.

Article 10 Force majeure
10.1 Force majeure also includes a circumstance over which Interieur by Gina has no influence or cannot reasonably have any influence.
10.2 In the event of force majeure, Interieur by Gina's obligations will be suspended. If the period lasts longer than 2 months, either party is entitled to terminate the assignment without any obligation to pay compensation in that case.
10.3 If Interieur by Gina has already partially fulfilled its obligations when the force majeure occurs, it is entitled to separately invoice the part that has already been executed or executable and the client is obliged to pay this invoice as if it concerns a separate assignment.

Article 11 Complaints procedure
11.1 Complaints should preferably be made known to Interieur by Gina by email immediately and within 14 days after completion of the assignment.
11.2 If a complaint is justified in the opinion of Interieur by Gina, Interieur by Gina will still carry out the work as agreed. If performance of the agreed work is no longer possible or useful, Interieur by Gina may decide to adjust the invoice.

11.3 If the client submits a complaint outside the period stated in 11.1 and due to the passage of time it can no longer be determined whether the complaint is justified, for example whether a defect was already present at the time of delivery or whether this arose later due to another cause outside Interior by Gina's responsibility, no repair or replacement can take place.

Article 12 Other provisions
12.1 Interieur by Gina reserves the right not to process an order.
12.2 Interieur by Gina reserves the right to place the result of an assignment in the form of drawings and photos on its website or to use it for any other form of publicity. Interieur by Gina will always take the client's privacy interests into account.
12.3 All legal relationships and assignments to which Interieur by Gina is a party are exclusively governed by Dutch law. Even if the party involved in the legal relationship lives and/or is established abroad. The competent court is the District Court of Utrecht.
12.4 Both parties will only appeal to the court after they have made every effort to prevent a dispute.
